Plan fiduciaries

Where a plan uses outside fiduciaries, those roles are filled by independent firms engaged for the plan — typically an ERISA §3(16) plan administrator for specified administrative duties and an ERISA §3(38) investment manager for discretionary investment management.

Those appointments allocate defined fiduciary functions under ERISA. They do not eliminate the plan sponsor’s responsibility to select and monitor those providers, and they do not transfer tax, legal, or settlor decisions to Retirement Tax Architects.

Retirement Tax Architects does not act as a 3(16) administrator or a 3(38) manager, does not take discretion over plan assets, and does not serve as the plan’s named fiduciary.
